$41 Million Maritime Verdict for Seaman Who Died from Spider Bite Aboard Ship

Verdict · Starr County, Texas (state district court, maritime claim) · 2015

After trial: The case later settled for $10 million.

Won by The Buzbee Law Firm.

A Starr County, Texas jury awarded $41.1 million to the family of seaman Jose Flores, who died after being bitten by a brown recluse spider while working aboard a dredging vessel, on maritime claims of unseaworthiness and negligence against the vessel operator. The case later settled for $10 million.

What happened

Jose Flores was a seaman who was bitten by a brown recluse spider while working aboard a dredging vessel in July 2010. The bite, which might be dismissed as an ordinary workplace hazard, contributed to a grave decline in his health, and Flores died in March 2013. His estate pursued the vessel operator for his death.

Under general maritime law, a vessel owner owes seamen a duty to provide a seaworthy ship. A ship without adequate pest control can give rise to a claim of unseaworthiness alongside a claim of negligence. The plaintiff's side pursued both theories: that the vessel was unseaworthy, and that its operator had been negligent in allowing the conditions that exposed Flores to the spider.

The case went to a six-day trial in state district court in Starr County, Texas, where maritime law governed the claims. In December 2015 the jury returned a verdict of roughly $41.1 million for Flores's estate. Texas Lawyer, reporting through its Law.com platform, covered the result under the headline crediting Tony Buzbee with the win, and the appellate record in the later malpractice suit identifies Christopher J. Leavitt, of The Buzbee Law Firm, as the lawyer who represented Flores.

The verdict did not stand as the final recovery. After trial, the vessel operator and its insurers settled the estate's claim and a related suit for $10 million. That settlement, and the defense's handling of the case, later became the subject of a separate legal malpractice action against the defense firm, which reached the Texas Court of Appeals.

$352.77 millionVerdictReversed on appealTX

On September 7, 2019, Ulysses Cruz, a 48-year-old United Airlines ramp worker serving as a wing walker at George Bush Intercontinental Airport, was struck from behind by an Allied Aviation Fueling Company of Houston van whose driver said the morning sun was in his eyes. Cruz was paralyzed from the chest down and suffered a stroke two days later that cost him the use of his dominant right arm. After a two-week trial before Judge Ravi Sandill, a Harris County jury on October 25, 2021 found Allied 70 percent and driver Reginald Willis 30 percent at fault and awarded Cruz, his wife and their two children $352.7 million in compensatory damages. Judge Sandill conditioned denial of a new trial on a $117.5 million remittitur of noneconomic damages, which the family accepted, and an amended judgment of about $235.3 million was signed February 7, 2022. Allied appealed, the parties reached a confidential mediated settlement, and on July 18, 2023 the First Court of Appeals vacated the judgment and dismissed the case at the parties' joint request.
