About Michael Livingston
Michael K. Livingston joined the Honolulu firm then known as Davis and Levin in 1986, after serving as Mountain States Regional Counsel for the American Civil Liberties Union in the late 1970s and coaching rowing at intercollegiate and international levels. He became a partner in 1990, and the firm was renamed to include his name in 1996. Mr. Livingston specializes in litigation with a focus on medical negligence, major personal injuries, substantial commercial disputes, insurance bad faith, and civil liberties violations. He has also taught as an Adjunct Professor of Law at the University of Hawaii's William S. Richardson School of Law. He has been named Hawaii's Lawyer of the Year in plaintiffs' medical malpractice litigation in 2013, 2017, 2019, 2022, and 2024, and in plaintiffs' personal injury litigation in 2016, 2018, and 2024.

Davis Levin Livingston secured an $11 million federal settlement, requiring U.S. Attorney General approval, after Tripler Army Medical Center's cascading delivery-room errors, including a misplaced oxygen tube left in place for more than forty minutes, caused a newborn to develop spastic quadriplegia and cerebral palsy.
A federal judge found Tripler Army Medical Center negligent in supervising a nurse who sexually assaulted a sedated intensive care patient in March 2001. After a six-day bench trial, the court awarded $906,000 under the Federal Tort Claims Act: $816,000 to the patient and $90,000 to her husband for loss of consortium.
