Joshua S. Markowitz is a founding attorney of Carcione, Henderson & Markowitz, LLP. He graduated from Roanoke College in Salem, Virginia in 1997 with a Bachelor of Arts in History and a minor in Religion and Philosophy, and received his Juris Doctor from the University of California, Hastings College of the Law in 2001, where he externed with Justice J. Anthony Kline. Markowitz began working for the Carcione law firm in 1999, became a partner at Carcione, Cattermole, Dolinski, Stucky, Markowitz & Carcione, and is now an owner and partner of the successor firm. He is an experienced trial attorney whose litigated cases have produced recoveries totaling over $70 million. He was admitted to the State Bar of California in 2003. Away from work he spends time with his wife Karol, his son Jonah, and his dogs, and enjoys going to the movies.
Proven verdicts and settlements
A San Mateo County jury found in March 2016 that the mattress pad in an Evenflo playard was defectively designed because its cover was close to impermeable to air, and that the defect killed a seven-month-old girl who had been put down for a nap at her daycare in 2010. The jury awarded her parents $8,000,000, $4,000,000 each, voting 10 to 2 on design defect and hanging on a companion negligence claim. Evenflo appealed. In November 2018 the First District Court of Appeal affirmed the jury's special verdict findings but reversed the judgment and sent the case back for a new trial limited to apportioning fault between Evenflo and the daycare, because the trial court had refused to instruct the jury on comparative fault. No final judgment figure against Evenflo appears in the public record after that.
