About Robert Komitor

Robert I. Komitor serves as of counsel at Levy Konigsberg LLP and functions as lead trial lawyer in products liability, negligence, and personal injury cases. He focuses on mesothelioma, hazardous waste, and pollution matters. He earned a Master's degree in Marine Environmental Sciences from Stony Brook University's Marine Sciences Research Center and his law degree from Hofstra University School of Law, where he served as an editor of the Hofstra Law Review. He has been consistently named among the nation's Best Lawyers in mass torts and was designated Lawyer of the Year in Mass Tort Litigation and Class Actions for New York City (Plaintiffs) in 2021. $16.5 million verdict ($15 million to the estate and $1.5 million loss of consortium; Whittaker Clark & Daniels 50 percent at fault; judgment after settlement offsets raised to $3.3 million on appeal in 2020; reversed and dismissed by the Court of Appeals in 2022)Verdict

A Manhattan jury awarded $16.5 million on April 7, 2017 to the family of Florence Nemeth, a Long Island woman who died of peritoneal mesothelioma after eleven years of daily use of Desert Flower dusting powder made with talc supplied by Whittaker, Clark & Daniels. James Kramer, Robert Komitor and Nicholas Novack of Levy Konigsberg tried the case, the first cosmetic talc mesothelioma verdict in New York. The Appellate Division upheld liability in 2020 and set the net judgment at $3.3 million, but on April 26, 2022 the Court of Appeals reversed and dismissed the case, holding that the plaintiff's experts never established that she was exposed to enough asbestos to cause her disease.
